Eat your heart out Anthony Zuiker...Anthony Kennedy has decided that the History of the United States in the Civil War, World War I, World War Two, Korea and Vietnam are irrelevent. In the Boumediene case just brought down from Mt. Sinai, Kennedy and the other Liberal Judges decided they know better than the peoples elected representatives. We can call them the '5 Kings', "the Elitists' or the 'D.C 5', but whatever you call them it should go down into the annals American History as insane!
He believes that the Congress cannot make laws to deal with such issues, because they did and he did not see the virtue in a Representative Democracy any longer. In over 200 years we have never allowed alien combatants to gain access to our courts. Our Congress voted to establish its own proceedures which have been followed since, that is until the 5 Kings decided they new better.
Despite a Constitution which grants War decisions and administration to the Executive branch and Law making to the Legislative, the 5 Kings decided they know better.
Congress over-ruled the 5 Kings twice before on similar issues of Foreign Combatants at GITMO, but the 5 Kings are not so easily swayed to Constitutional Democracy. They have ignored historical precedent, Congressional action and the structure of Constitutional Authority, so what do they hold sacred?

The insanity of the 5 Kings invading into Executive and Legislative authority ignores the balance of power, the seperation of power and the prescribed powers as enumerated in the Constitution. Requiring the Military to act as officers of the court rather than soldiers places them, informants, INTEL OPS, those we aim to protect, and force integrity into jeopardy.
We cannot begin to envision the unintended consequences of such insane Judiical Overreach...but read Michael Yon's book and see how difficult it already is for our persons in arms in harms way, with the already buedensome regs from over layerly regulations.
The 5 Kings have put an unintended target on each Terrorists head, the Military will begin to Shot first to kill, instead of capture potential sources of INTEL, jeapardizing future actions as a result. Prior to 9/11 and the Sen. Torricelli limits on dealings with shady contacts, we failed to gain any solid INTEL on our Terrorist Enemies. Today, upon this ruling we have placed in harms way, all the gains made in Iraq, Afghanistan and the Middle East in general, by systemically killing any possible INTEL detainment of suspected Terrorists. By increasing the burden of proof and elevating the suspect to a defendant status in the Federal Courts of the United States we have granted them the presumption of innocense...whereby, placing a CSI like burden upon each soldier in the field...do they drop all force operations for the sake of gathering evidence or place the operation at risk to stop and read the Miranda Rights to a particular suspect?
Um-Uh Obama, has already accepted the flawed logic of the 5 Kings. The Princes of California overruled the peoples vote on Marriage as did the Princes of Massachusetts. The lack of adherence to our Constitutional system is only getting worse. President Woodrow Wilson created the consideration of a Living Constitution,....but I think they have created a Monster!
Oh, I have a new name, the FRANKEN COURT!
